ESTATE PLANNING CHECKLIST

Estate planning is an essential step to ensure your wishes are honored, your loved ones are protected, and your assets are handled the way you intend. Whether you’re just getting started or reviewing an existing plan, this checklist will help you identify the key documents and decisions needed to create a solid foundation. From powers of attorney to digital asset access, each item below plays an important role in preparing for the unexpected and avoiding unnecessary legal complications for your family:

  1. Durable Power of Attorney (Financial)

This document authorizes your trusted agent to manage your financial affairs. It allows your loved ones to access bank accounts, pay bills, and assist with financial matters if you’re unable or unwilling to do so. It remains effective even if you become incapacitated.

  2. Healthcare Power of Attorney

This document specifies your medical care preferences and appoints someone to make healthcare decisions on your behalf if you’re incapacitated (e.g., in a coma or undergoing surgery).

  3. Beneficiary Designations

    • Bank Accounts
    • Life Insurance
    • Retirement Accounts (401K, IRA, etc.)
  4. DMV Transfer on Death Application

Complete a Transfer on Death Form to name a beneficiary for your vehicles (cars, mobile homes, boats), allowing them to avoid probate.

  5. Transfer Upon Death Deed(s)

This deed allows your land, home, or other real property to pass without probate. However, it may have certain risks, so consult with an attorney before executing.

  6. Funerary Arrangements

Document your funeral, burial, or cremation preferences to help your family honor your wishes without uncertainty.

  7. Digital Assets

Ensure someone can access your online accounts and passwords. Best practice is to store usernames and passwords separately, with instructions on how to locate both.

  8. Will

Have a properly executed Last Will and Testament to clarify your wishes regarding your estate and guardianship of minor children.
